The Morning Whip (the “Program”)

GROUP-COACHING CALLS

There will be nine (9), sixty (60) minute group-coaching calls with Erika Lyremark. Participants will be invited to zoom-in, listen and participate in these group-coaching calls. Depending on how many Participants call in, space to be a live participant in the group meetings may be limited, however. Participants will be provided a link so they can watch / listen to a replay of the group meetings whenever they wish. If Participants download the group-coaching calls replays by April 30, 2024, they will have unlimited access to the replays.

ACCOUNTABILITY CHECK-INS

Email hello@dailywhip or DM Erika on Instagram @dailywhip to report your bold moves. Replies will be made during regular business hours Monday – Friday.

DATES

March 11, 2024 – March 29, 2024

In the case of an illness or family emergency, group-coaching calls times and dates are subject to change.

PAYMENT                                                                                                                             

The cost for the Program is four hundred, ninety-five dollars ($495.00).

If you elect to enroll via one of the payment plan options, your credit card will be automatically charged when each payment is due.

If you choose the two-payment plan your credit card will be charged two hundred, seventy-two dollars ($272.00) when you register and automatically charged ($272.00) the following month.

If you choose the three-payment plan your credit card will be charged one hundred, ninety dollars ($190.00) when you register and automatically charged ($190.00) each month for 2 months.

If for some reason one of your payments cannot be processed successfully, your account shall be suspended until the payment is received. In addition, should you fail to make any payments required under this section, Lyremark, Inc. reserves the rights to recuperate such payments through any and all means necessary, including through a lawsuit or through the use of third-party collection firms. If it is necessary to pursue payment through these methods, Lyremark, Inc. is entitled to also recuperate any fees spent on collection efforts.

Refund Policy

If you make all 9 bold moves AND check in with me via email or DM me on Instagram for each bold move you make and are not satisfied with your results, you will receive a full refund within 5 business days. Your refund request must be emailed to hello@dailywhip.com by March 29, 2024.

PARTICIPANT-CONTRIBUTED CONTENT

You agree that your participation in the Program confers upon you no rights to use, ownership or copyright. You release Lyremark, Inc. and Erika Lyremark, and their employees, agents, and assigns from all liability which may arise from any and/or all claims by you or any third party in connection with your participation in the Program.

You understand that Lyremark, Inc., and Erika Lyremark has the unlimited rights to edit, use, broadcast or sell any ideas that Participant contributes to The Program.

Right to Terminate Membership

Lyremark, Inc. may, in its sole discretion, terminate a Participants enrollment if that Participant displays any conduct which is disruptive, abusive, threatening or otherwise offensive to other Participants, or any employee, contractor or discussion moderator of Lyremark, Inc., whether that conduct occurs on Zoom call, email, or DM. No refund shall be issued to a Participant whose enrollment is terminated under this provision. If a Participants enrollment is terminated, that Participant shall not be permitted to re-enroll in the Program at a future date.

INTELLECTUAL PROPERTY RIGHTS

Our Limited License to You.

All the materials available through the Program (the “Materials”) are the property of Lyremark, Inc. and are protected by copyright, trademark, and other intellectual property laws. The Materials are provided solely for your personal noncommercial use. You may not use Materials in a manner that constitutes an infringement of Lyremark, Inc’s. rights or that has not been authorized by the company. More specifically, unless explicitly authorized in these Terms of Service or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any of the Materials. You may, however, download and/or print one copy of individual pages of the Materials for your personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.

When addressing financial matters in the Program we’ve taken every effort to ensure we accurately represent the Program and its ability to grow your business and improve your life. In particular, you should regularly consult a doctor in all matters relating to physical or mental health, particularly concerning any symptoms that may require diagnosis or medical attention. Neither we nor our partners, or any of their affiliates, will be liable for any direct, indirect, consequential, special, exemplary or other damages that may result, including but not limited to economic loss, injury, illness or death. You alone are responsible and accountable for your decisions, actions and results in life, and by your use of the information in the Program, you agree not to attempt to hold us liable for any such decisions, actions or results, at any time, under any circumstance.

Confidentiality

The power of the Program is to learn from Erika Lyremark and other Participants. All information provided by Erika Lyremark under the Program or provided by you to Erika Lyremark is confidential and shall not be disclosed to any third parties. If confidential information is provided in a setting involving Erika Lyremark and other Participants of the Program, all such information is to be kept confidential. What happens in the Program, stays in the Program.
